Gina Kirschenheiter has been dragged into boyfriend Travis Mullen’s ongoing legal battle with ex-wife Meghan Mullen.
After Travis, 41, filed an emergency motion against Meghan, demanding that he be granted full legal and physical custody of their kids, Presley, Bennett, and Joseph, due to drug use concerns, Meghan fired back, claiming their children are afraid of both their father and the 41-year-old Real Housewives of Orange County star, and accusing Gina of mocking the weight of one of their sons.
“After all of the time, energy and expense [Meghan] and I have gone to in seeking ‘workable’ custody orders, [Meghan’s] behavior continues to undermine my custodial time and attempt to alienate the children from me,” Travis alleged in court documents obtained by In Touch Weekly on May 13.
Signaling his and Meghan’s current custody deal, which the exes signed in 2021, agreeing to share physical and legal custody, Travis said he now wants a professional to monitor Meghan’s time with their kids.
“Additionally, [Meghan] allows [one of their children] to miss an unacceptable amount of school, threatening his continued academic progress, as well as our custodial rights,” he explained. “Further, I believe [Meghan’s] behavior has been damaging to our children and is not in their best interest. For over a year, I have tried to reason with the [Meghan] and have sought her cooperation in co-parenting our children, but nothing has improved.”
According to Travis, he has “grave concerns” about Meghan’s “ability to parent [their] children.”
“Creating a threat of a referral to the Office of the District Attorney, she has been denying me my custodial time with [one of their kids],” he continued.
Travis then alleged that Meghan failed to submit drug tests on two separate occasions, as required by their agreement, on June 3, 2024, and January 6. As he explained, the most recent request he made for Meghan to take a drug test was prompted after she allegedly “passed out in her car in the vehicle ‘drop off line’” at their children’s school.
“I have been notified on three different occasions by various individuals that [Meghan] has passed out in the car pick up line. Despite this, [Meghan] refuses to submit to a test,” he wrote in his motion. “Her refusal to take a court ordered drug test further supports my suspicions that [Meghan] is consuming illegal substances, which could drastically impair her ability to care for our children.”
“I asked for this specific order as I have long suspected that [Meghan] ingests some illegal prescription medication that impairs her ability to care for our children,” he added.
As RHOC fans may recall, Meghan agreed to submit to drug testing when she and Travis settled his restraining order against her, which he obtained in 2023 after accusing her of assaulting him.
Although Travis said he agreed to settle the case because a permanent restraining order against Meghan would have denied her custodial rights, she continues to get in the way of his own rights.
“This has been an ongoing issue for the last several years. Between June 2020 and August 2023, for example, I filed eleven (11) reports with law enforcement after [Meghan] either interfered with my custodial time or completely denied it. Since that time, August 2023, the Orange County Sheriff’s Department has refused to take further incident reports, despite my repeated requests,” he shared.
As the court denied Travis’ motion for an emergency order, Meghan slammed his request and mentioned Gina in her own court filing.
“His filings appear intended to punish and control me, not to protect the children. Travis is using the family court system as a tool of coercive control and retaliation. Our children … have repeatedly reported to me that they are afraid of their father and his girlfriend, Gina Kirschenheiter,” she wrote. “[One of our sons] has described being mocked for his weight and his name by Gina. All three children have told me Gina speaks negatively about me and creates tension in the household.”
Meghan then detailed her past relationship with Travis.
“During our marriage, Travis regularly intimidated me and caused me to fear for my safety. He would yell, lose his temper and physically shake or shove me. Travis has made numerous false allegations that I am using illicit substances and passed out in the car pickup line. I categorically deny this. These statements are untrue and unsupported by any credible evidence,” she declared. “The school principal and staff have never reported any such concerns.”
Meghan went on to state that she has been complying with drug testing as their agreement requires.
“I have fully complied. However, Travis and his girlfriend Gina have not been held to any comparable standard despite concerning behaviors,” she added, turning the tables on the couple. “Their repeated public accusations have been amplified in the media, and yet neither has submitted to random testing, despite multiple indicators that such testing would be prudent in the interest of our children’s safety.”
“I am asking for protection, fairness, and balance — so that our children can live in a safe, consistent environment free from fear, coercion and public shaming,” she concluded.
Following the filings, an insider close to Gina told In Touch Weekly that Meghan’s accusations against her are “total BS” and that Gina would never mock the kids.
A hearing on the matter has been scheduled for July 10.
